VPD Shares New AB 481 Military Equipment Use Policy with the Community for their Input
VALLEJO, CA - The Vallejo Police Department (VPD) invites Vallejo
residents and stakeholders to review and provide input to our Assembly Bill (AB) 481 Military Equipment Use Policy through May 5, 2024.
The Vallejo Police Department ensures responsible and lawful utilization of military equipment in law enforcement operations. In line with Government Code § 7071, VPD emphasizes that all military equipment shall be used solely for law enforcement purposes and in strict accordance with the United States and California State Constitutions, California Penal Code § 835a, and relevant departmental policies.
The newly unveiled policy reinforces stringent guidelines governing the acquisition, use, and oversight of military equipment within the department. Under the leadership of the Chief of Police, a designated Military Equipment Coordinator will oversee compliance and act as a liaison for matters concerning military equipment.
Key highlights of the policy include:
- Comprehensive Oversight: VPD will conduct annual inventories of all military equipment, ensuring transparency and accountability in its usage.
- Community Engagement: The department will host annual community engagement meetings to discuss its military equipment policy, inviting public participation and addressing concerns regarding funding, acquisition, and usage.
- Training Requirements: Officers must undergo specialized training, including POST-certified basic training and equipment-specific instruction, prior to utilizing any military equipment.
- Approval Process: Any acquisition or use of military equipment must receive approval from the governing body, ensuring adherence to legal and regulatory frameworks.
- Exigent Circumstances Protocol: In exigent circumstances, military equipment may be acquired or used with approval from the Chief of Police, with subsequent reporting and oversight measures.
- Annual Reporting: VPD will submit annual reports to the governing body detailing military equipment's inventory, usage, and fiscal impact. These reports will be made publicly available on the department's website.
- Community Engagement Meetings: Within 30 days of releasing the annual report, VPD will hold public community engagement meetings to discuss the report and address any public inquiries regarding the department's use of military equipment.
